In quoting Abraham Lincoln, the ADR Institute of Ontario states that when it comes to disputes, the “nominal winner is often a real loser – in fees, expenses and waste of time.”
There are, of course, the financial costs – even for the winner, which never covers your entire expenses. Even in the most favorable cases there is still a significant out-of-pocket expense to consider. A recovery of 100% of your legal costs is extremely rare.
However, and for many involved in litigation that goes before the Courts, there is a higher cost. Anyone who has had to deal with a Court action will tell you that the level of stress and time demands are a significant distraction from both their business and personal lives. The human, emotional, and physical toll often far exceeds the financial costs of litigation. This is a hidden cost that many people do not consider.
As a result, an experienced and skilled lawyer will seek to minimize these “hidden” expenses. The best way to achieve this outcome can be through a resolution of disputes through mediation.
Leveraging his experience and high ethical standards, Ian McBride has successfully obtained his certification in Foundational Conflict Management & Mediation. He has joined the ADR Institute of Ontario and Canada.
Ian’s rates are $1500 for a half day (3 hours) or a full day (6 hours) at $2,500 plus disbursements and HST. Any hour or part thereof after will be billed at $425 plus HST. Mediations and Arbitrations normally commence at 10:00 a.m. in the morning or 2:00 p.m. in the afternoon but Ian can be flexible with the start time.
